Funding Structure

GCMA takes three important factors into account before we charge our clients for the work, they ask us to do for them namely: experience of the allocated lawyer or solicitor dealing with your matter, the complexity of your matter, and the estimated/expected time to work for you.

Legal Aid Funding

GMCA is set up as a non-Legal Aid service provider.

Variable Rate

Our charging rates will vary between £129.00 per hour up to £185.00 per hour (Solicitors' guideline hourly rates - GOV.UK (www.gov.uk) depending on the matters mentioned in the tables below.

  • 20 years long residence for adults and 7 years continuous residence by a child, including discretionary leave to remain in the UK.
  • The First-tier Tribunal (Immigration and Asylum Chamber) are responsible for handling appeals if the Home Office has decided to: refuse your protection claim (also known as 'asylum claim' or 'humanitarian protection') revoke your protection status. refuse your human rights claim.
  • Barrister will need to be instructed to carry out the advocacy, drafting and appearance.
  • The Upper Tribunal (Immigration and Asylum Chamber) are responsible for handling appeals against decisions made by the First-tier Tribunal (Immigration and Asylum) relating to visa applications, asylum applications and the right to enter or stay in the UK. The handle applications for judicial review of certain decisions made by the Home Office, normally relating to immigration, asylum and human rights claims.

FUNDING SPECIAL CONDITIONS
  • Office of the Public Guidance [OPG] helps people in England and Wales to stay in control of decisions about their health and finance and make important decisions for others who cannot decide for themselves.
  • The Court of Protection is a specialist Court, designed to protect vulnerable people. They make decisions regarding both financial affairs and personal welfare where the individual lacks capacity to make such specific decision.
Additional Costs

GMCA’s does not include the following additional cost:

  • Disbursements such as searches fee, interpreter/translation fee and so on.
  • Barrister’s fee,
  • The Home Office application fees.
  • The National Immigration Health Surcharge fee payable to the Home Office.
  • Expert [report] fees,
  • Various Court application fee.
  • Application fee for filling appeals to Tribunals.
  • Solicitor’s travel costs (if we have to travel outside our office on your behalf, for example to a Tribunal hearing or to the Home Office).
  • You will pay some these fees separately and failure to pay it means we can’t progress your matter.
Value Added Tax [“VAT”]

GMAC does not currently register and charge the VAT on any of our fee. It is common knowledge that the percentage rate of the VAT is 20% unless otherwise stated. We will be endeavoured to advise you whether VAT will be applicable when you instruct and some of the service provider may charge Value Added Tax (“VAT”) on their cost/fee.

CRIMINAL Matters
  • A guilty plea in Magistrates’ Court in respect of a minor motoring offence concluded at one hearing will be £500.00 including travelling time and fare.
  • A more complicated matter requiring two hearings will be between £750.00.
  • A trial (not guilty hearing) covering two hearings on different days will be £500. 00
  • A 2-day full trial would be between £950.00 to £2,200.00 with no charges for travelling time and expenses.
Affidavit Sworn Statutory Declaration
  • GMCA acts as Commissioners for Oaths and we can act as a required legal witness for the swearing of an Oath at the fixed fee of £10 and just £5 per exhibit (per person).
  • Oaths and Affidavits are legal documents that are required for court proceedings or as part of probate and other civil procedures. An exhibit is a document or item referred to in the Oath, Affidavit or Statutory Declaration.
  • Drafting an affidavit or statutory declaration from the scratch will trigger a fixed cost of £100.00 [plus VAT if it is applicable] excluding cost of swearing it.
  • Change of Name Deed will trigger a fixed cost of £75.00 only.
